• 列治文教育局修改師生守則
    有構成人權與安全問題之嫌

    校園行為守則應正面反映教育宗旨和使命,目的是維持學校紀律,令環境安全有序。使學生在沒有滋擾下專心學業,同時培育美好的品德,將來成為一個能貢獻社會、奉公守法的公民。好的行為守則應該清楚易明,只列出對學童最基本的要求,切忌繁複累贅,讓學童們有自由思想和發展的空間。

    一月列治文教育局推出的行為守則修改稿正與這些原則背道而馳,由現行精簡的兩頁紙改成冗長的四頁,不但如此,修改內容用詞含糊詭秘,滿佈政治術語,令人覺得不知所言,卻又似有所言。在這些隱晦的文字之中,顯突出兩大問題,就是安全和人權問題。

    安全問題

    一、修改的行為守則忽視整體校園安全

    行為守則修改初稿删除現有「禁制武器、危險物品、毒品、酒精」等字句,卻在「尊重個人/社會衛生安全」一項,加入「為學童提供資料及資源…教育他們在學校及校區中有關禁制及非法毒品的使用」。這樣無形中把學童置於危險環境中,為毒品和武器大開方便之門。校局應保留這些字句,並張貼學校牆上,又嚴格執行。家長要的是保護學童遠離毒品,而不是教導學童學習如何「安全」吸毒注毒。家長反對加入「為學童提供資料及資源…教育他們在學校及校區中有關禁制及非法毒品的使用」,學校對毒品、武器、危險物品必須採取零容忍政策。

    二、修改的行為守則無清楚列明如何保障學童使用廁所和更衣室的私隱和安全

    行為守則修改初稿說要確保更衣室和廁所使用者得到尊重、安全和私隱得到保障,這就是修稿文字詭秘之處,使用廁所最重要的是安全和私隱,與受尊重與否有什麼重要關連?這裡沒有清楚指明女童使用廁所和更衣室時,行為守則如何確保他們的私隱和安全。

    人權問題

    一、修改的行為守則貶低平等人權

    Respect for Human Rights「尊重人權」一項,指明要輔導員認識對人權的要求,把同性戀、變性人的權利特別提出、其他人的人權卻沒有特別提及,例如自閉症的學童是最容易受欺凌的類別,在修改行為守則中卻沒有特別提及,令家長覺得不公平,他們子女的人權沒受到同等的重視。守則不應顯突某一組別人士的特別權益。

    二、修改的行為守則潛在限制言論自由和宗教自由的風險

    在Respect for Human Rights「尊重人權」、「舉報違規」、「尊重個人及社會健康及安全」三項中,要求教師和學生在所有情況下要表示能夠運用「適合的言語,即是尊重和用包含性的言語」,以「提高尊重性的溝通」,並要舉報所有「不適合的言語」。這都是主觀的字句,違反人權自由憲章下所賦與教職員、家長及學童的基本權利。另外修改守則初稿規定師生要在一定的框架內「一起學習、一起工作」,他們要「遵從包括,但不限於,個別學校規矩和程序的要求」。這些指什麼?要遵從些什麼要求?教職員和學童有無自由不參與和他們宗教信仰或個人信念相違背的活動?若不遵從他們會否受到舉報和紀律處分?這些規則只會變成滋擾,會破壞教職員、學生和家長間的和諧,導致彼此間的矛盾。加拿大人權及自由憲章中的意見自由、表達自由及宗教自由等必須是行為守則的基礎,所有行為操守必須以此為規範和準繩。

    另外,家長和市民要知道卑詩省教育廳的指令實在說什麼,指令要求各校區必須設有行為守規,守則也必須按諮詢結果而修改,以確保學園安全。但要留意的,是指令雖然說要加入”sexual orientation, gender identity or expression,  卻並沒有指定要作出如此大幅度的修改,更非如學委翁善恆在以上訪問中所說:「因為省政府要我哋(列治文學校局)咁改,……呢啲係我哋無辦法,呢啲係省政府話到明要我哋咁樣改法。」訪問片段和省府指令有很大的差距,民選代表必須為自己的言論負責。

    列治文教育局行為守則修改 

     

    ACTION TO SAVE THE RICHMOND SCHOOL DISTRICT

    Richmond Board of Education is now running a public consultation on the amendment of Code of Conduct.  The deadline for the consultation is April 18, 2017.  There are just two weeks left.  Richmond Board of Education needs to hear from thousands of Richmond residents and business owners on how Members of the School District should truly be protect by the Code of Conduct.  (Note: Members of the School District include students, parents and staff.)

    Problems 1

    The Board proposes to remove prohibition of weapons, dangerous articles, alcohol and illegal drugs from the Code of Conduct and to teach school children about restricted and illegal substance use on school and district sites.

    Our Voice: Keep the prohibition in the Code of Conduct and display it in a prominent area in the school.  Remove clause “Educate about restricted and illegal substance use on school and district sites.”  Work with parents to keep school children away from restricted and illegal substances.

    Problem 2

    The Board proposes to ensure that appropriate safe places exist at all district sites to support the safety, respect and privacy of all users, such as washrooms and change rooms.  That is good, but it does not specify how the safety and privacy of all users are protected.

    Our voice:  In order to ensure the safety and privacy of all users, segregated washrooms and change rooms for biological male and female use must be clearly written in the Code of Conduct and strictly implemented.

    Problem 3

    The Board discriminates against all other groups of prohibited grounds of discrimination by mentioning only the sexual orientation, gender identity and expression (SOGI) group under Respect for Human Rights.

    Our Voice: Under Respect for Human Rights, in the second paragraph, it should be changed to read “School counselors will be informed and knowledgeable about expectation pertaining to human rights of race, colours, ancestry, place of origin, religion, marital status, family status, physical or mental disability, sex, sexual orientation, gender identity or expression, or age of that person or class or persons.”
    It is the requirement of the Provincial Standards for Codes of Conduct Order that each of the prohibited grounds of discrimination set our in section 7 and 8 of the Human Rights Code be included.

    Problem 4

    The Board proposes to make all members of the School District “demonstrate the use of respectful and inclusive language in all settings” without defining what “respectful and inclusive language” means.  This goes against the freedom of speech which is guaranteed to all members by the Canadian Charter.

    Our voice: Delete this clause and put “No abusive or obscene language is allowed.”

    Problem 5

    The Board proposes to “frame how (members of the district) learn and work together” and that they “will abide by the expectations of individual school protocols and processes”.  What are the “individual school protocols and processes”?  This remains unknown.  The question is will members of the district be allowed to opt out of activities which contradict to their beliefs, conscience and religions?

    Our voice: Leave this clause out.  The clause is against our Charter.  Canada is a free country.
    This Proposed Code of Conduct sets serious consequences for those who fail to abide, which may include suspension, appearing before a Board of Review for students and a disciplinary review for employees or a police investigation

    What can we do to save the Richmond School District?

    1. Draft a letter using the above as a reference.  Be respectful but firm.  For transparency, request the Board to disclose the result of the consultation as well as the revised amendment of Code of Conduct to the public in a duly and timely manner.

    2. Share your draft letter with your circle of Richmond friends and ask them to email it to the School Board.  Any one of any age who lives in Richmond or has a business in Richmond can email the letter.  One does not need to be a parent or has children in the public school to get involved.

    4. Forward a copy of the letter to Parents Care at parentsrichmond@gmail.com  for the group to keep count of the number of responses.

  • 一個可能扭轉政局的黨領競選

    今年5月27日的加拿大保守黨黨領競選,為加拿大社會和政治氣候提供一個扭轉的機會,因為黨領是由黨員選出,在下屆大選中若加拿大保守黨勝出,選出的黨領將成為加拿大總理。

    過往在聯邦政黨中,只Conservative Leadership2017有保守黨的政策比較保守,但問題是現今14名候選人中只有Brad Trost 和 Pierre Lemieux 兩人公開支持傳統婚姻和保護生命權利,並在過往投票記錄中一直持堅定立場。其他候選人在社會政策上都不持保守立場。所以,於今次黨領競選的結果,對加拿大未來社會的道德政策走向,將有可能具有很大影響。

  • 列治文校局修改師生守則
    諮詢必須公正透明

    Richmond Board of Education列治文教育局年初發出師生行為守則修訂初稿,在會議中決定會公開內容,並於4月18日前搜集公眾意見。各華文媒體為此一直跟進報導,並訪問家長意見,但奇怪的是從校局來的聲音似乎不多,而華裔校委的發表又給人一種欲言又止,欲語還休的感覺。幸得星島日報記者一雙鷹眼,查根究底,直追源頭,2月8日新聞見報後才知道原來事有蹊蹺。

     

    學委是民選而出,職責是代表選民,聆聽家長,服務學童。而列市教育局過往制定的政策中,均確認家長在子女教育上參與的重要性,和校局Alice Wong Trustee與家長的夥伴關係,為何最近校局向學委發出封口令,又發言前必須經過審閱查核?既然行為守則已經向公眾公開了,為何華人校委藉華人媒體向居住眾多的列治民華人溝通時,仍有諸多限制,諸多不便,還要向傳訊經理諸多請示呢?

     

    對於Jonathan Ho列治文教育局所提出的行為守則修改,本會甚為關注。修改把不准攜帶武器、危險物品、酒精、非法毒品等字句刪除,卻在「尊重個人、社會衛生及安全」一項,加入「向師生提資料,教導學童認識非法和違禁毒品,及在校園內的使用安全」。另外,提到廁所和更衣室,修改初稿表示支持所有使用者要安全、受尊重、有私隱。學童需要使用廁所、更衣室時,最重要是安全和私隱得到保護,這和尊重與否沒有什麼關係。然而,條文沒有寫明校局如何令所有學童的安全和私隱得著保護,如何介定男女按生理性別分廁和分開更衣室使用,以維護校園紀律。修改初稿用辭十分含糊詭秘,令人摸不著頭腦,更令家長們的擔憂。還有,守規中指出師生要用「合適的、尊重的、包含性的言語」來加強溝通,而不合適的言語則會受到舉報和紀律處分,處分包括要家長和學校配合,令學童學習和改造。這令人想到多倫多大學教授Jordon Peterson因為拒絕用三十多種的代名詞來稱呼學生,而被同性戀人士舉報說他不尊重,大學也向他兩度發出警告信。這是不是就是列治文師生守則中所指的包含性、尊重性的合適言語呢?還有一點令人困擾的,就是守則規定,師生要在學校指定的框架內「一起學習、一起工作」,這樣,如果教員或學生拒絕參與一些和個人信念相違的活動,又會否受到舉報和處分?他們會否被強迫學習改過呢?

     

    從用封口令來限制校委個人發言權,至用師生守則來規限學童必須說什麼話、參與什麼活動,看來列治文校區自由安全的學習環境,似乎被一種不可言喻的侷促氣氛所籠罩。設立師生行為守則目的是維持學校的紀律和安全,讓學童在沒攪擾的情況下無憂無慮地學習,但列治文教育局是否正在相反的方向走?相信他們要向公眾作個清楚的交待。
